Benefits of a trade mark


A trade mark protects a particular type of intellectual property (IP). It can be a unique symbol, word(s), sound, number, image or scent used to represent a business or its products.

Once registered, a trade mark is an asset that gives you the sole right to use, license or sell it to others.

Before registering a trade mark


To be eligible to register a trade mark you must:

  • apply as an individual business owner and not under your business name
  • be an individual, company, incorporated association or a combination of these
  • use, or plan to use the trade mark

You can apply for your trade mark through the IP Australia website. Before you register for a trade mark make sure you know:

  • what goods and services to protect
  • the type of trade mark you need
  • if your trade mark is available
