Australian Business Number Registration

You may require an Australian Business Number (ABN) if you are operating a business, organisation or enterprise in Australia. An ABN is a single identifier for all business dealings with the Australian Taxation Office and other government departments and agencies.

Applying for an ABN is not compulsory. However, once you have registered your entity for an ABN you will be able to:

  • register for GST and a business name
  • be endorsed as a deductible gift recipient or an income tax-exempt charity
  • get an Australian domain name.

Goods and Services Tax (GST) Registration

Goods and services tax (GST) is a broad-based tax of 10% on most goods, services and other items sold or consumed in Australia.

You must register for GST:

  • when your business or enterprise has a GST turnover (gross income from all businesses minus GST) of $75,000 or more
  • when you start a new business and expect your turnover to reach the GST threshold (or more) in the first year of operation
  • if you're already in business and have reached the GST threshold
  • if your non-profit organisation has a GST turnover of $150,000 per year or more
  • when you provide taxi or limousine travel for passengers (including ride-sourcing) regardless of your GST turnover - this applies to both owner drivers and if you lease or rent a taxi
  • if you want to claim fuel tax credits for your business or enterprise.

Registering for GST is optional if your business or enterprise doesn’t fit into one of these categories. If you choose to register, generally you must stay registered for at least 12 months.

If you're not registered for GST, check each month to see if you've reached the threshold, or are likely to exceed it. You need to register within 21 days of your GST turnover exceeding the relevant threshold.

Registration or Notification of a Fixed Food Premises - City of Ballarat

You will need this registration or notification if you intend to operate a food business from a fixed food premises, such as a café, shop, or factory.

Local councils classify all food businesses in their municipality according to the highest risk food activity undertaken at the food premises. The class of your food premises determines what requirements you will need to meet before registration.

There are five classes of food premises:

  • class 1: premises are where the food being handled or served is to vulnerable people within a hospital, aged care, childcare setting, or by home delivery services
  • class 2: premises that handle potentially hazardous foods
  • class 3A: premises that are home-based businesses and accommodation getaway premises that undertake specific food handling activities.

Child Employment Licence

Most businesses will need a child employment licence to employ children under 15 years old in Victoria, whether the work is paid or voluntary. 

A child must be: 

  • 11 to deliver newspapers and advertising material
  • 13 to deliver pharmaceutical products or do other types of work, such as retail or hospitality. 

There is no minimum age for working in entertainment, but there are industry-specific requirements.  If you will be employing children in the entertainment industry, you must apply for an entertainment specific licence. 

Children can only be employed for light work, that is not harmful to their health, safety, wellbeing and development. A child cannot work: 

  • on a building site
  • on a fishing boat 
  • selling door-to-door. 

Use the Child Employment Decision Tool  to find out if you need to apply for a licence. Where a licence is granted, a business can employ multiple children under one licence.

You may need this certificate if you intend to own land in:

The liability to pay GAIC only arises once in relation to land at the first occurrence of a GAIC event, although payment may be deferred in certain circumstances.

It is a one off-contribution, payable on certain events, usually associated with urban property developments, such as buying, subdividing, and applying for a building permit on large blocks of land.

In most instances, if you are buying a new home on a residential lot in the contribution area, your developer will have already paid the GAIC as part of developing the land.

However, if you buy or own an existing property, your land may be affected. GAIC certificates are issued at no charge, and tell you the GAIC status of land and what, if any, liability exists.

National Police Certificate

A National Police Certificate is a full record of your criminal history. It displays all releasable court outcomes (sentences, convictions and findings of guilt) from all Australian States and Territories.

Many regulators will need you to provide a National Police Certificate as part of the application process for a licence, registration or other approval. Employers or volunteer organisations may also need you to provide a National Police Certificate before you commence employment or volunteer work.

An application may be made by you as an individual, or on behalf of the organisation that needs the information (with your consent).

Victoria Police will conduct nation-wide name checks and deliver the results to you or the organisation requiring the information. Generally, information such as an individual's criminal history cannot be released by Victoria Police to an organisation without written consent, and strict guidelines apply to the release of criminal history information to any individual or organisations.

Please read the Information Release Policy to be aware of the information released as a result of the check.

Victoria Police does not conduct checks for overseas applicants or applicants for residency or citizenship. These applicants must apply to the Australian Federal Police (AFP). Please visit the Australian Federal Police website for further details.

You will need this registration if you or your company employ workers in Victoria. You will need to register for WorkCover insurance if you pay more than $7500 in wages per financial year, or you employ apprentices or trainees. Registration for Fringe Benefits Tax (FBT)

You are required to pay Fringe Benefits Tax (FBT) if you provide any benefit to an employee or an employees' associate (e.g. a family member, etc).

Benefits include any rights, privileges or services you supply to an employee in relation to their employment. For instance, you are required to pay FBT if you:

  • allow an employee to use a work car for private purposes
  • give an employee a cheap loan
  • reimburse an expense incurred by your employee (e.g. school fees)
  • provide entertainment by way of food, drink or recreation.

FBT is separate from income tax and is based on the taxable value of any benefits you provide. You can process your FBT via your monthly or quarterly Business Activity Statement (BAS).

Please note that you are required to pay FBT whether:

  • these benefits are provided by you, an associate of yours or a third party under an arrangement with you
  • an employee is a current, future or former employee.

Some employers, including charities, may need to work out the status of their workers. Many will be volunteers, however, some will be contractors and employees. Generally, benefits provided to volunteers and contractors do not attract FBT.

You can register for FBT online, by phone, though your registered tax agent or by lodging your annual FTB return.

Vehicle Registration

You will require this registration if you intend to use a motor vehicle or trailer on a public road. It is illegal to use an unregistered motor vehicle or trailer on a public road.

There are four broad registration classes:

  • standard motor vehicles (cars, 4WDs, vans, trucks, motorcycles, prime movers and buses
  • trailers (including caravans)
  • recreational motorcycles (motorcycles intended for use on local and forest roads outside built up areas)
  • miscellaneous vehicles (vehicles designed for specific tasks such as tractors, backhoes, crane, street sweepers).

Trailers that weigh less than 200 kilograms, are not wider than its towing vehicle and are not more than 3m long are exempt from the requirement to be registered. A motor vehicle that is being towed is also exempt, as are trailers used for certain agricultural purposes.

If you are moving to Victoria permanently, or have bought a vehicle with interstate registration, you will be required to register it in Victoria.

If you wish to have a particular registration number assigned to your vehicle you may purchase registration number rights from the Agency.

This licence covers the use of music in:

  • staff recreation and lunchroom areas

  • by staff from computers or personal devices
  • the telephone on hold system on lines for external calls.

This licence legally authorises the public performance of copyrighted music from within the Australasian Performing Right Association and Australasian Mechanical Copyright Owners Society (APRA AMCOS) and Phonographic Performance Company of Australia (PPCA) global inventory of registered songs (called works), sound recordings and music videos.

Your licence will be obtained from OneMusic Australia and covers the rights of the above two organisations.

Land Tax

Land tax legislation imposes an annual tax on the total taxable value (previously known as unimproved value) of all land owned in Victoria at midnight on 31 December of the year preceding the year of assessment where the total taxable land (excluding exempt land) is greater than the threshold.   • a holiday house

The minimum standards also require businesses to provide information relating to workplace gender equality issues to the Agency in the workplace gender equality report.

Despite the repeal of the Workplace Gender Equality (Minimum Standards) Instrument 2014 by this instrument, the 2014 instrument, as in force immediately before that repeal, continues to apply in relation to a reporting period that commenced before the repeal of the 2014 instrument.

Notification of Unclaimed Monies

You will need to comply with this lodgement if your business holds any unclaimed money.

General unclaimed money is any amount of $20 or more that is legally payable to an owner but has not been paid for 12 months or longer (as of 1 March of that year). This includes:

  • share dividends
  • salaries and wages
  • rent and bonds
  • debenture and interest
  • unpresented cheques
  • trust money.

Principal and interest are treated as one sum.

Operating Your Business on a Public Holiday (Restricted Trading Days)

Victorian law specifies that there are two and a half restricted trading days each year:

  • Good Friday
  • Christmas Day
  • Between 12.01 am and 1pm on ANZAC Day.

On these days only exempt shops are permitted to open.
